Situation: Sugnall Tea Room is an established local business that sits within the 2-acre, historic Sugnall Walled Garden near Eccleshall, Staffordshire, ST21 6NF.
The eatery premises is now available To Let for use as a tea room, restaurant or eatery property to the right Tenant, with the Tenant able to decide on their offerings to make best use of the property and the historic surroundings.
HEADS OF TERMS
Rent: £3 400.00 per annum and Open to offers
Exclusive Rights:
The exclusive rights to hold agreed events within the Walled Garden for the period of the agreement and operate the eatery property.
Period of the Agreement: Initial one-year agreement starting on 1st March 2024. It is then expected that a successful term would be followed by a new, longer term agreement.
Undertaking by Landlord:
Landlord to manage a volunteer team to maintain the grounds within the Walled Garden in a tended and presentable condition. Volunteer team to maintain flower beds, existing fruit trees and path edgings, grow annual vegetable crops on the northern two quarters, maintain herbaceous flower beds and cut grass.
Maintenance Of Structures:
Landlord to maintain the existing exterior structures within the tenancy at the Walled Garden in no worse state as currently exists. There may be opportunity for investment in the existing or new infrastructure to support the tenant following a successful initial term.
Tenant:
Tenant to provide minimum of £5,000,000 Public Liability Insurance and to indemnify the Estate against any claim arising from the event holders activities.
Consideration Payable:
Quarterly in advance
Outgoings: The Tenant will be responsible for paying all outgoings, rates and service charges due for the eatery.
Website and Promotion:
Links will be provided to the event holder’s website from the Sugnall website.
Transfer undertaking Provision:
No employees will be transferred as part of this agreement and the responsibility and supervision of the volunteers will remain with the Estate. Details of the current tea room staff can be provided should they wish.
Restrictions:
Any Events at the eatery are to be approved at least a fortnight in advance by Dr Jacques before confirming.
Assignment: The agreement is personal to the Tenant and cannot be assigned to a third party without the Estates approval.
Toilets:
For operation of the Tea Room/Restaurant/Eatery only, the toilets at the Business Centre can be used although a contribution towards cleaning will be demanded via the service charge.
Service Charge:
A service charge, based on the sq. ft. of the eatery property, of costs of cleaning and car park maintenance of currently £3,400 plus VAT per annum to be levied for use of the car park and toilets at the Business Centre.
Litter Picking/Damage:
Tenant responsible for clearing up and picking up litter and disposing of rubbish generated by the use of the eatery. If there is any damage to the garden or structures by customers, the event holder will be responsible for arranging repair to the Estate’s reasonable satisfaction.
