CONDITIONS OF SALE
The sale of the vacant possession freehold will be subject, inter alia, to the following conditions:
1. Contract.
2. The approval of the purchase price by the Ely Diocesan Board of Finance.
3. The property shall be used for private residential purposes only and not more than a total of 13 dwellings shall be erected or placed thereon.
4. Nothing shall be done, suffered or permitted on the property which is, or may become, a nuisance annoyance or disturbance to the tenants and authorised occupiers or users of the Vendor’s adjoining or nearby property to the east and north.
5. No part of the property nor any existing or future building thereon or on any part thereof shall at any time be used as or for a place of amusement, hotel, tavern, inn or public house nor shall any spirituous or fermented liquors at any time be sold in or upon the property or any part thereof.
6. The reservation by the Seller of:-
[a] all existing rights of light, air, water supply, soil and drainage in respect of its adjoining or nearby property.
[b] the right to connect into and use any of the services or roads to be constructed on the land to be sold.
7. The Buyer shall be responsible for putting and maintaining the boundary fence shown between the points marked “A” - “B” on the sale plan in stock-proof condition to the reasonable satisfaction of the Seller.
8. Any windows, other than ground floor windows, which overlook the south-eastern boundary of the land edged green on the plan shall be of fixed lights incapable of being opened and glazed with obscured glass.
9. The transfer of the land edged red, green and blue on the sale plan will include a restriction that the estate roads may only be used to service the maximum 13 dwellings to be constructed on the site in accordance with the outline planning permission and the permission in principle.
10. The Buyer shall:-
(i) complete the construction of the estate roads and footpaths to serve the development of the site within 5 years of completion of the sale, the said estate roads and footpaths to be of sufficient width to enable the future development of the adjoining land to the north-west of the boundary marked “C” - “D” on the sale plan
(ii) make provision for the possible future development of the land adjoining the boundary marked “C” - “D” on the plan to enable the developer of the latter (on further payment to the Seller and the Buyer) to connect:-
(a) a spur road (and footpaths with required visibility splays) into the estate road to be constructed on the land edged red, green and blue on the plan;
(b) into any drains or other services constructed on the land edged red, green and blue on the plan.
N.B. Prospective purchasers are advised that:-
[a] There is an electricity wayleave for equipment crossing the site. Notice was served on Eastern Power Networks on the 13th February 2019 and acknowledged as Notice to Terminate on the following day.
[b] The Vendor has a call option for the transfer of the land edged blue on the plan which it will exercise at its
